Terms of Service

The terms that apply when you use this website and the services described on it.

These Terms of Service (“Terms”) govern your access to and use of nextplus.org (the “Site”), operated by Next Plus LLC (“Next Plus,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Services and Engagement Agreements

The Site describes managed IT, financial, and federal contracting services that Next Plus offers. Descriptions on the Site are informational summaries only. All services are provided exclusively under a separate written engagement agreement, statement of work, purchase order, or contract signed by Next Plus and the client. Nothing on this Site constitutes an offer, a quotation, or a binding commitment to provide services, and no client relationship is created by visiting the Site or submitting a form.

No Warranties on Site Content

The Site and its content are provided on an “as is” and “as available” basis. While we work to keep the content accurate and current, we make no warranties or representations of any kind — express or implied — about the completeness, accuracy, reliability, or availability of the Site or its content, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Content may be updated, corrected, or removed at any time without notice. See our Disclaimer for additional notices.

Limitation of Liability

To the fullest extent permitted by law, Next Plus LLC and its members, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — arising out of or relating to your use of, or inability to use, the Site or its content, even if we have been advised of the possibility of such damages. To the extent any liability is not excludable under applicable law, our total aggregate liability arising from your use of the Site will not exceed one hundred U.S. dollars ($100). Liability relating to services we perform for clients is governed solely by the applicable written engagement agreement, not by these Terms.

Intellectual Property

The Site and its content — including text, graphics, page designs, and logos identifying Next Plus — are the property of Next Plus LLC and are protected by copyright, trademark, and other intellectual property laws. You may view and print Site content for your own informational, non-commercial use; any other reproduction, distribution, or modification requires our prior written permission. Third-party names and logos displayed on the Site — including those of technology partners and distributors — are the property of their respective owners and are used to identify genuine business relationships; their appearance does not imply any endorsement of this Site by those owners.

Acceptable Use

When using the Site, you agree not to:

  • Violate any applicable law or regulation;
  • Attempt to gain unauthorized access to the Site, its servers, or any connected systems;
  • Interfere with the Site's operation, including through scraping at disruptive volumes, denial-of-service activity, or the introduction of malicious code;
  • Submit false, misleading, or fraudulent information through our forms;
  • Use the Site to transmit spam or unsolicited commercial messages.

We may suspend or block access to the Site for conduct that violates these Terms.

Third-Party Links

The Site may link to third-party websites, including our booking service at book.nextplus.org and partner or government verification sites. We are not responsible for the content or privacy practices of third-party sites; your use of them is at your own risk and subject to their terms.

Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in San Joaquin County, California, and you consent to the personal jurisdiction of those courts.

Changes to These Terms

We may revise these Terms from time to time. The current version will always be posted on this page with its “Last updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
